Background:
Mr. Cappuccio's practice focuses on complex commercial litigation, business litigation, bankruptcy,
construction law, telecommunications law, and property owner association rights. He has considerable
experience in cases involving torts, contract & business disputes, fraudulent transfers to
corporate insiders, the filed tariff doctrine, condemnation, medical care provider claims against HMOs,
the Residential Construction Liability Act (RCLA), the Deceptive Trade Practices Act
(DTPA), the Racketeer Influenced and Corrupt Organizations Act (RICO), securities fraud, the
Federal Telecommunications Act of 1996, professional negligence claims, and property owner association rights.
In addition, Mr. Cappuccio regularly represents parties in a variety of bankruptcy litigation matters, and he is often retained as special counsel and general counsel for Chapter
7 bankruptcy estates.
Mr. Cappuccio spent four years in Washington, D.C., and worked on a variety
of projects involving the Department of Energy and Environmental Protection Agency.
He also acquired extensive political and legislative experience as an intern for former
Senate Majority Leader George Mitchell.
Mr. Cappuccio is "AV" Rated by Martindale-Hubbell (the highest rating available). He has been voted by his peers as one of the "Best Lawyers in San Antonio" for five
years in a row in the areas of business litigation and bankruptcy. In 2007, 2008 and 2009, Mr. Cappuccio
was selected as a Texas Super Lawyers "Rising Star," an honor reserved for the top 2.5 percent of
attorneys in the state.
