Property & Homeowner Association Rights

PCPBJ’s Property Owner Association (POA) & Homeowner Association (HOA) Practice Group is managed by Elliott Cappuccio and Buck Benson. Mr. Cappuccio is an “AV Rated Preeminent Attorney” by Martindale-Hubbell. This is the highest rating available for legal ability and ethics. Mr. Cappuccio focuses on assessment collections, DCCR enforcement, and litigation matters for property owner associations. Mr. Cappuccio has been recognized by Texas Monthly Magazine as a Texas Super Lawyer for the last nine (9) years, and by Scene in S.A. Magazine as one of the Best Lawyers in San Antonio for the last twelve (12) years. In 2011, Mr. Cappuccio also received the prestigious Outstanding Lawyer Award in Litigation from the San Antonio Business Journal. Mr. Benson has also been recognized as one of the Best Lawyers in San Antonio for the last nine (9) years. Mr. Benson focuses on DCCR preparation, board governance, restrictions, resolutions, and other non-litigation matters for property owner associations. Mrs. Levy is a senior associate attorney who assists Mr. Cappuccio and Mr. Benson on property owner association matters. Mrs. Levy has been recognized by Scene in S.A. Magazine as a rising star lawyer for several years. PCPB also has a team of six (6) highly experienced paralegals devoted to property owner association matters.

PCPB represents approximately five hundred (500) POAs, HOAs, and condominium associations throughout Texas. PCPB offers flexible payment arrangements, including flat fee and deferred billing arrangements for most assessment collection matters, and discounted hourly fees for other matters such as DCCR violations and general counsel work. Mr. Cappuccio and Mr. Benson also offer each property owner association client up to one (1) hour of free legal consultation each year, which can be used to request the presence of legal counsel at annual meetings, monthly meetings, telephone conferences, or other unbudgeted matters, at no charge whatsoever. For general counsel and other hourly work, PCPB will provide estimates and “not to exceed” quotes so that clients know what something will cost in advance and there are no surprises.
