Background:
Mr. Weiss’ mission is to promptly and courteously assist his clients and their families to avoid legal and taxation problems of various types, and to take advantage of opportunities provided for in the law, by proactively planning their personal and business affairs. Mr. Weiss' education and experience make him uniquely qualified to help his clients achieve their goals.

 

Mr. Weiss majored in Finance and Economics at Georgetown University, earned his law degree and a Masters in Business Administration (with an accounting concentration) at Vanderbilt University and a Master of Laws in Taxation at New York University. He has been a licensed attorney for over 20 years, earned a C.P.A. and practiced in the field of Taxation with several accounting and law firms for nearly 15 years. Subsequently, and prior to joining Pulman, Cappuccio, Pullen & Benson, Mr. Weiss established his own law firm and practiced on his own for 5 years.

 

Mr. Weiss believes that every individual should have a comprehensive Estate Plan that is designed to provide protection for them and their loved ones during their lifetime and after their death, and must be done with the person’s unique circumstances, needs and desires in mind. If properly drafted and executed during one’s lifetime, estate planning documents such as Wills, Trusts and Powers of Attorney will not only leave a person’s assets to their chosen heirs, but will do so in a way that eliminates or minimizes taxes, ensures that the individual and any of their young or incompetent heirs are properly protected and preserves their family’s privacy.

 

Mr. Weiss also practices in the areas of Probate and Heirship. Probate is the process undertaken after an individual with a valid Will dies. Once an Independent Executor has been named by the Probate Court, he or she pays the decedent’s debts and taxes and then transfers the remaining assets to the decedent’s named heirs (which can be individuals, trusts or charities). An Heirship Hearing is necessary if a person passes away Intestate (without having executed a valid Will). Heirship Hearings are generally more time-consuming and expensive than Probate; additionally, if you die Intestate, State law will determine the identity of your heirs and the portion of your net estate that they will each receive (good reasons to see an Estate Planning attorney at your earliest convenience).

 

Finally, Mr. Weiss helps those engaged in business to establish and operate appropriate business entities. A business entity (such as a Limited Liability Company or a Limited Partnership) is created in order to limit potential liabilities arising from those business activities in the future, for Estate Tax planning purposes, or both. Mr. Weiss strongly urges any individual or group that is doing business with the general public to create, fund and operate that business within the appropriate business entity, and to do so before such activities give rise to potential liabilities.

 

Mr. Weiss proudly volunteers for, and contributes to, many worthwhile charities, and serves on the Board of Directors of a local non-profit organization. He was raised in New Jersey, but got to Texas as soon as he could. He and his wife of 9 years have 2 adorable and precocious children.
